On 26th July (Monday), after Arijit Singh filed a petition, Riyaz Iqbal Chagla, the justice, in his interim order restrained 8 Online platforms as these platforms have used Arijit Singh’s “Personality Rights”. The court ordered them to remove all the content and the voice conversation tools.

Arijit Singh, the popular Indian singer-composer, has claimed in the court that these AI platforms provide AI tools to blend artificial sounds and recordings by mimicking his voice, characteristics, and other qualities.

Hiren Kamod, Arijit’s Lawyer said, Singh has intentionally refrained from any brand endorsement or gross commercialization of his personality characteristics since many years. The High Court agreed to this concern and the judge said:

“What shocks the conscience of this court is the manner in which celebrities, particularly performers such as the present plaintiff are vulnerable to being targeted by unauthorized generative AI content.” 

Not only Arijit Singh, in past, popular personalities like - Amitabh Bachchan, Jackie Shroff and Anil Kapoor have advanced towards multiple courts to seek a strict action against this unapproved use of their perona’s.

The composer-singer filed the petition seeking protection for his official rights. The High court posted the matter for 2nd September hearing. The HC noted:

“In my view, creation of new audio or video content/songs/videos in the Plaintiff’s AI name/voice, photograph, image, likeness and persona without his consent and commercially using the same could potentially jeopardise the Plaintiff’s career/livelihood.”

“Permitting the defendants (AI platforms) to continue exploiting/violating the Plaintiff’s (Singh) personality/publicity rights, without Plaintiff’s consent also jeopardises the Plaintiff’s career as a performer/singer and his status of a celebrity… The act of creating and disseminating videos… on how to use unauthorised AI models to replicate a celebrity’s voice such as Plaintiff without his consent cannot be shielded under the right of freedom of speech and expression.”

The AI development made way to easily create deepfakes and change one’s own voice to that of a celebrity’s.

The Ecommerce platforms and Social media also misused the voice & other features of Anil Kapoor without his consent damaging the publicity rights of Anil Kapoor. 

The Bombay High Court also ordered these platforms to remove the fake video of Ashish Kumar Chauhan, NSE MD & CEO, in which he was featured offering stock recommendations.
