Kejriwal Suffered a Setback as HC Disrupted His Release 2024

The Enforcement Directorate approached the Delhi High Court on 21st June 2024 (Friday), where he challenged the bail granted to the Delhi CM Arvind Kejriwal in the Money Laundering Case Stemming from the alleged excise scam.

It was a major setback for Kejriwal as the Delhi High Court reserved its order on the bail plea of Kejriwal yesterday. This means that Kejriwal, the Aam Aadmi Party chief, has to stay in jail for now. 

  • This bail order is on hold until a final decision is announced, which is expected by the 24th (Monday) or 25th (Tuesday) of June 2024. 
  • The High Court has guided the counsel to file their written submissions by this coming Monday.
  • This change occurred when the Enforcement Directorate (ED) reached the High Court and challenged the local court’s verdict.

Arvind Kejriwal Bail

The Rouse Avenue Court granted bail to Arvind Kejriwal on June 20th (Thursday) in the alleged liquor policy scam case. Enforcement Directorate in its plea demanded the trial court order for an important hearing before the bench of Justices (Sudhir Kumar Jain and Ravinder Dudeja). It stated the case fill would come in 10-15 mins and after that, it would hear the matter. 

Who Represented the Enforcement Directorate in the Kejriwal Case?

SV Raju, the Additional Solicitor General (ASG), represented the ED, looked for a stay on the trial court’s order battling that the agency was not given a proper chance to argue in its case. 

He alleged that the INR 45 Crores was detected and its use in Goa Elections has been documented. The court remarked the Enforcement Directorate (ED) is incapable of proving its claims. 

SV Raju criticized the judicial decision and highlighted a concerning misjudgment. He said that it is a falsification of justice for any judge to admit to granting bail without analyzing the case documents. As per Raju, the bail should be kept on hold for this error only.

SV Raju accused Kejriwal of his involvement in two money laundering cases. As per SV Raju, the first case revolves around Kejriwal’s personal space where he demanded INR 100 Crore. The second case revolves around Kejriwal’s claim as a witness and it is claimed that the Aam Aadmi Party used the funds obtained from “Illicit Activities” to pay for his election campaigns, thus partaking in money laundering. These cases linked Kejriwal and the Aam Aadmi Party (AAP) to money laundering, an act of misconduct.

Manu Singhvi, the advocate & representative of Arvind Kejriwal’s case, argued that the stay on the trial court’s order is equal to the cancellation of the bail. He criticized the Enforcement Directorate and stated that it is now using a new trick to find a way around legal procedures. He highlighted that it is trying to bypass the law, and stressed that there is a clear difference between cancellation of a bail and grant of a bail. 

Delhi High Court Final Verdict on Kejriwal Bail 2024

The Delhi High Court has held the operation of the trial court order on granting bail to Arvind Kejriwal, Delhi’s Chief Minister, on 21st June, until any outcome is announced on the Enforcement Directorate’s application that is seeking a stay. 

Sudhir Kumar Jain stated that he reserved his order on the Enforcement Directorate’s application that is seeking a stay for 2-3 days and will announce it at the start of the upcoming week. He issued a notice on the plea filed by the Enforcement Directorate challenging Arvind Kejriwal’s bail in the Delhi Excise Policy Case.
